Constitutional Amendments Proposal by Noor Qureshi
Introduction: Being a country rooted in Islamic
principles, with supreme authority belonging to Allah, it is essential to align
the legal and constitutional framework with Islamic teachings. This proposal
suggests key amendments to ensure that the constitution reflects the values of
independence, religion, and national unity. These changes are designed to be
considered by all political parties.
Amendments:
- Review
of Laws:
- All
laws that contradict Islamic principles must be revisited and abolished
if necessary.
- Elimination
of Interest (Riba):
- Riba
(interest)-based financial transactions should be abolished nationwide.
- All
commercial banks should be restructured as partnership-based entities.
- Only
state-owned banks will regulate monetary transactions within the country.
- Unification
of the Legislative Assembly:
- Abolish
provincial assemblies and establish only a National Assembly to legislate
for the entire country.
- Election
of National Assembly Members: a. Male Participation: All males aged 25 and
above will have the right to participate in elections. b. Female
Participation: Unmarried females aged 25 and above will have the right to
participate in elections. c. Nomination: Candidates must be male and
nominated by a group of people, not self-nominated. d. Independent
Candidacy: All candidates must run as independents, without any political
party involvement. e. Member Role: Assembly members are to receive a
salary but no development funds. Their primary duty will be legislation.
- Election
of the Head of State: a. Members of the Assembly will elect an Advisory
Body. b. The Advisory Body will agree on and elect a Head of State (no
self-nomination). c. No Senate: The Senate will be abolished. d. The Head
of State, in consultation with the Advisory Body, will appoint governors
for each division or region from the elected Assembly members.
- Government
Departments:
- All
government departments will be led by Secretaries appointed to each
department.
- Appointment
of the Judiciary:
- The
Chief Justice and divisional justices will be nominated by the Advisory
Body and appointed with the consultation of the National Assembly.
- Judicial
positions should not be permanent government jobs.
- Military
Respect:
- The
Army is the pillar of national defense and must be respected. No negative
propaganda against the military, whether led by political parties or
movements, will be tolerated.
- The
general strength of the army should be reduced and redirected towards
internal security, with a focus on personnel skilled in operating
equipment and advanced technology.
- Military
Leadership:
- A
high-level test and interview should be conducted for the appointment of
the Army Chief. The age for eligibility should be between 40 to 60 years.
- Tax
Reform:
- Less
sales tax and focus on Zakat Money, professional taxes .
- Division-Wide
Tax Collection:
- Taxes
should be collected at the divisional level and used for local
development, with a portion allocated to national expenses.
- Contractual
Government Jobs:
- All
government jobs will be contractual for three years, with renewal based
on performance.
- Merit-Based
Job Appointments:
- Government
jobs will be awarded based on tests and interviews rather than academic
certificates or degrees.
- Pension
Abolishment:
- The
pension system will be abolished.
- Support
for Elderly Citizens:
- Individuals
aged 60 and above (husband and wife) who do not have a business or
financial support will be provided with a stipend for their living
expenses.
- Education
Reform:
- A
new education policy will focus on fostering creativity and
research-minded individuals for higher education. Others may be directed
toward employment in the private or government sector or the business
industry.
- Encouragement
for Mothers:
- Married
women will be encouraged to focus on the holistic development of their
children from birth until schooling age, contributing to nation-building.
Financial support will be provided to mothers if their husbands are
financially weak.
- Foreign
Investment Restriction:
- Pakistani
nationals will be prohibited from foreign investment.
- Global
Muslim Support:
- Pakistan
will lead and support Muslims globally in times of hardship, in every way
possible.
- Non-Muslim
Taxation:
- Non-Muslim citizens
will be taxed according to their financial capacity and Islamic laws.
